Throughout these Terms, references to "Fabric Mouse", "we", "our" or "us" mean Young & Son Limited trading as Fabric Mouse.

For the purposes of these Terms:

Business Customer means any person or organisation purchasing goods or services wholly or mainly for business, commercial, educational, trade or professional purposes.

Consumer means an individual acting for purposes wholly or mainly outside their trade, business or profession.

Customer means any person purchasing goods or services from Fabric Mouse.

Goods means any physical products supplied by Fabric Mouse.

Services means any service provided by Fabric Mouse, including but not limited to servicing, repairs, demonstrations, training (where offered), installation or consultancy.

Website means any website owned or operated by Fabric Mouse.

Working Day means Monday to Friday excluding public holidays in England.

You may use our website only for lawful purposes.

You agree not to:

  • misuse the website;

  • interfere with its operation;

  • introduce viruses or malicious software;

  • attempt unauthorised access to any part of the website;

Where a manufacturer improves or revises a product, we reserve the right to supply the current equivalent model provided its primary function remains substantially the same.

7. Availability of Goods

Some products shown on our website are held in UK stock.

Other products may be:

  • ordered specifically for individual customers;

  • imported from overseas manufacturers;

  • available for pre-order;

  • temporarily awaiting shipment.

Where estimated arrival dates are provided, they are estimates only.

Although we work closely with our suppliers, delivery schedules can occasionally change due to factors outside our control, including but not limited to:

  • manufacturer production schedules;

  • shipping delays;

  • customs inspections;

  • port congestion;

  • severe weather;

  • transport disruption;

  • public holidays, including Chinese New Year;

  • circumstances beyond our reasonable control.

8. Placing an Order

When you place an order through our website, you are making an offer to purchase goods or services.

Your order is subject to acceptance by Fabric Mouse.

An automatic order confirmation confirms that we have received your order. It does not mean that your order has been accepted or that a binding contract has been formed.

Acceptance of your order occurs when we dispatch the goods, begin providing the service, or otherwise confirm acceptance.

We reserve the right to refuse or cancel any order where reasonably necessary, including (but not limited to):

  • pricing errors;

  • product availability;

  • suspected fraudulent activity;

  • payment authorisation failure;

  • supplier issues;

  • legal or regulatory requirements.

If payment has already been taken for an order that cannot be fulfilled, an appropriate refund will be processed promptly.

Orders may be delayed, cancelled or refunded where satisfactory verification cannot reasonably be obtained.

We appreciate our customers' understanding, as these checks help protect both our business and genuine customers from fraud.

11. Pricing

Unless stated otherwise, all prices displayed on our website are shown in Pounds Sterling (£).

Where applicable, VAT will be shown in accordance with current UK legislation.

We reserve the right to amend prices without prior notice.

Price changes will not affect orders that have already been accepted.

Despite our best efforts, occasional pricing errors may occur.

If a pricing error is discovered before your order has been accepted, we will contact you to explain the situation and offer the opportunity to proceed at the correct price or receive a full refund.

We are not obliged to supply goods at an incorrect price where the error is obvious and could reasonably have been recognised as such.

12. Payment

Payment must be made using one of the payment methods offered at checkout unless an alternative arrangement has been agreed with us in writing.

Certain products or services may require a deposit or payment in full before work commences. Where this applies, the payment requirements will be made clear before your order is accepted.

Ownership of goods remains with Fabric Mouse until payment has been received in full.

If payment cannot be authorised or is later reversed, we reserve the right to suspend or cancel the order where legally permitted.

13. Delivery

Delivery times shown on our website are estimates only unless specifically stated otherwise.

Whilst we make every effort to dispatch orders promptly, delays may occasionally occur due to circumstances outside our reasonable control.

Customers are responsible for ensuring that:

  • the delivery address is accurate;

  • someone is available to accept delivery where required;

  • suitable access is available for larger deliveries.

If a parcel is returned to us because an incorrect delivery address was provided, delivery was refused, or the courier was unable to complete delivery, additional delivery charges may apply before the goods can be re-dispatched.

Risk in the goods passes to the customer once they have been delivered to the delivery address provided at the time of ordering.

14. Free Delivery Promotions

From time to time, Fabric Mouse may offer free delivery promotions, including free delivery on qualifying orders over a specified value.

Unless expressly stated otherwise, free delivery promotions apply only to qualifying physical products requiring shipment.

Free delivery promotions do not apply to:

  • servicing or repair work;

  • warranty services;

  • labour charges;

  • engineering services;

  • demonstrations;

  • training services;

  • gift vouchers;

  • digital products or downloadable content;

  • memberships or subscriptions;

  • any other non-physical products or services.

Where an order contains both physical goods and services, any free delivery promotion applies only to the shipment of the qualifying physical goods.

Fabric Mouse reserves the right to amend or withdraw promotional delivery offers at any time. This will not affect orders that have already been accepted.

15. Consumer Cancellation Rights

Consumers purchasing online may have cancellation rights under the Consumer Contracts Regulations.

Nothing within these Terms limits or removes your statutory consumer rights.

16. Business Customers

Certain consumer protections available under UK consumer legislation do not apply to Business Customers.

Where goods or services are purchased for business, commercial or professional use, additional or different terms may apply.

Business Customers should ensure that any goods purchased are suitable for their intended application before placing an order.

17. Demonstrations and Product Advice

Fabric Mouse offers demonstrations on selected products.

Demonstrations are generally provided by prior appointment and are subject to staff availability.

Any advice provided during a demonstration is based upon the information available at the time and the intended use discussed with the customer.

Customers remain responsible for ensuring that the product they purchase is suitable for their individual requirements.

18. Training

Some machines supplied by Fabric Mouse may include product training or familiarisation.

Training availability, duration and method vary depending upon the manufacturer, machine model and any promotional offers available at the time of purchase.

Unless specifically stated in writing, training is not included with every machine.

Where training is included, separate booking arrangements may apply.

19. Special Orders and Imported Goods

Certain products are ordered specifically for individual customers or imported directly from overseas manufacturers.

Estimated arrival dates are provided in good faith but cannot be guaranteed.

Delays caused by manufacturers, international shipping, customs clearance, transport providers or other circumstances outside our reasonable control do not automatically give rise to compensation.

If significant delays occur, we will endeavour to keep customers informed and discuss the options available.

20. Compatibility

Customers are responsible for ensuring that accessories, software, consumables and other products purchased are compatible with their machine unless they have relied upon specific advice provided by Fabric Mouse.

If you are unsure whether a product is compatible with your machine, we encourage you to contact us before placing your order.

21. Trade-In Machines

Where Fabric Mouse agrees to accept a machine in part exchange, any estimated trade-in value is provided subject to inspection.

The final valuation may be adjusted where the machine differs materially from its description, has undisclosed faults, has suffered damage, or is missing accessories that would reasonably have been expected.

Trade-in machines become the property of Fabric Mouse once the transaction has been completed.

22. Intellectual Property

Unless otherwise stated, all content published on the Fabric Mouse website is owned by or licensed to Young & Son Limited.

This includes, but is not limited to:

  • product photography;

  • logos and branding;

  • graphics and artwork;

  • blog articles;

  • downloadable documents;

  • training materials;

  • website design and layout.

You may view, download or print content for your own personal, non-commercial use only.

You must not copy, reproduce, distribute, modify or commercially exploit any content from our website without our prior written permission.

Where goods are purchased for business use, our total liability shall not exceed the purchase price paid for those goods unless otherwise required by law.

Nothing within these Terms affects your statutory rights as a consumer.

  • customs inspections or border delays;

  • failures of utility providers;

Fabric Mouse shall not be considered in breach of these Terms where delays or failures arise solely because of such events.

Nothing within these Terms affects any statutory rights that cannot lawfully be excluded.

32. Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as severed from the remaining Terms.

The remaining provisions shall continue in full force and effect.

Where words such as "including", "includes" or "for example" are used, they are intended to illustrate examples and shall not limit the meaning of the preceding wording.

Words used in the singular include the plural where appropriate, and vice versa.
